What is Revenge Porn?

When two people break up, often times it is common for at least one of the individuals to complain about the other person on Facebook or some other type of social media site. Recently, however, we have seen instances where sexually explicit material involving the ex-girlfriend or spouse is being posted on the internet without that person's consent. This is a new type of conduct that has been dubbed "Revenge Porn".

Revenge Porn is a relatively new term to describe the posting of nude images or sexually explicit material on an Internet website as retaliation against an ex-spouse or girlfriend or boyfriend. It is usually a picture or image that was intended to be enjoyed only by the other person in the relationship. People that are still angry or upset about a break up or divorce are sometimes posting these pictures as a way of getting back at their former partner by seeking to embarrass and humiliate them with this material.

Is Revenge Porn Criminal or Civil in Nature?

Many states have enacted or are in the process of enacting laws making Revenge Porn a crime. It has been prosecuted under civil law as a copyright infringement similar to situations where someone's name and likeness is used without their permission.

Revenge Porn: Public Awareness

Revenge porn is a hot topic in Orlando, throughout Central Florida, and across the country due to an increased media exposure and high pressure from the general public to address and reduce revenge porn offenses. In a move that is sure to have a significant impact on what types of content may be shared on the Internet, Google has announced that it will remove nude or sexually explicit images that are posted without the subject's consent. This should greatly reduce the ability of individuals to engage in "Revenge Porn" on sites maintained by Google. To fight revenge porn Google plans to introduce a web forum to allow users to submit requests for these images to be taken down.

Some Steps You Can Take to Prevent Yourself From Becoming a Victim of Revenge Porn

If you are going to share nude or sexually explicit images with your partner, you may want to have them sign a confidentiality agreement where it is clear that they do not have consent to share these images in any other way.

Should you become aware that this material is posted without your permission, you should do everything you can to document and preserve evidence that this has occurred and take pictures, note the site where it appears, etc.

It is important to remember that even if the images are removed immediately the damage to your reputation may already be done.
