State: No charges in Daley Case

ORLANDO, Fla. (WOFL, FOX 35) - No charges will be filed against the elderly man who created a firestorm of controversy when his neck was broken during an encounter with an Orlando Police Officer.

Daniel Daley, 84, confronted an Orlando Police officer on September 18th over his car being towed.

According to police Daley was intoxicated, when he confronted a tow truck driver across the street from an Orlando bar on N. Orange Avenue. The two got into an argument, so the driver then called police to the scene.

Investigators said Daley put his hands on the responding officer several times. They said when Daley tried to punch the officer the cop was forced to take him to the ground.

Daley remains in a medically induced coma and his family has since retained high profile Orlando attorney Mark NeJame.

The Orlando Police have defended their officer's actions but said they are conducting their own investigation. Shortly after the incident, police recommended that Daley be charged with two felonies for assault and battery on a law enforcement officer.

Wednesday, the State Attorney's office said they would not pursue any charges in the case and they consider the investigation closed.
