Former Orlando Cop Charged with Murder of Son Release from Jail

ORANGE COUNTY, Fla. (WOFL FOX 35) - A retired Orlando police officer who prosecutors say shot and killed his son was released from jail Saturday.

Timothy Davis Sr. was granted $100,000 bond Friday by Circuit Court Judge Jenifer M. Davis following a hearing at which his wife Tarsha David spoke. "I would like my husband to be released so he can be with his family."

Apopka Police say on Oct. 1 Davis shot and killed his 22-year-old son, Timothy Davis Jr., during a fight over custody of Davis Jr.'s son. Investigators say the fight escalated and Davis Sr. went out to his car and grabbed a gun and then shot and killed his son.

The 47-year-old was arrested on a first-degree murder charge but a grand jury later indicted him on second-degree murder which entitled him to bond.

The state says he had plenty of time to walk away and this wasn't a case of a man just snapping or one acting in self defense. The defense disagrees. "He was a person in acute distress I don't think the state knows when he was severely beaten in his home. They may know when he walked out the door on the cameras but they don't know when he was assaulted and crippled," said Michael Lafay, Davis' attorney.

The defense claims even his son said as he was dying that he did not want his dad to go to jail.

As part of his bond Davis will wear an ankle monitor and be confined to his home except to go to church and get groceries. He will not be allowed to have any weapons in the house.
