Liens

A lien is a legal right or interest that gives a creditor a right to possess property of another person until that person pays a debt that they owe. There are different types of liens including, but not limited to: security liens for the payment of a loan; mechanics liens for the improvement of the property or something on the property; tax liens for the nonpayment of taxes and judgment liens which result from a court judgment.

A Mechanics’ Lien is a construction lien placed on your property to secure payment for labor or work done to improve the property. Mechanics Construction liens are governed by Florida Statute Section 713, Part I. Under the statute, Mechanics liens require a notice to owners/notice to contractors, notices of commencement, notice of termination of liens.

A notice to owners’ notice to contractors lets the owner know that a subcontractor is expecting payment for labor on the property. A notice to owner’s must be served either before or within 45 days of the start of the project.

A notice of commencement is required on projects that have a contract greater than $2,500.00. The notice of commencement must be filed with the clerk of courts, and it serves as a source of information about the project for potential lienors. The notice of commencement includes a legal description of the property to be improved, a general description of the improvements to be made, the owner’s contact information, the contractor’s contact information, the lender’s contact information, surety information, the contact information of person’s within the state who are designated to receive notices in place of the owner, expiration date of the notice of commencement and the notarized signature of the owner.

A notice of termination of liens terminates the period of effectiveness of a notice of commencement.

A Tax Lien is a lien placed on your property to secure unpaid taxes. If you never pay your taxes, the holder of the tax lien (usually the city or the county where the property is located) can order the property to be sold.

A Judgment Lien is a lien that is created when someone receives a judgment against you in a lawsuit. If you owe a creditor money and they file a lawsuit against you and win, they can receive a judgment lien against you which will give them an interest in your property. If the creditor records the judgment lien and decides to enforce it, they can petition to have the property sold.
