Powers of Attorney

A Power of Attorney is a legal document that gives someone “power” or authority to make decisions or take action on behalf of another person. The person that makes the power of attorney is called the principal and the person that is give the “power” or authority is called the agent. You can use a Power of Attorney for almost anything. You can give another person the “power” or authority to sign legal documents for you, sell your property or access your bank accounts. The Power of Attorney must be signed by the principal and witnessed.

There are different types of Powers of Attorney including: limited power of attorney, general power of attorney anddurable power of attorney.

A limited Power of Attorney gives the agent specific authority to take a specific action. A general Power of Attorney gives the agent authority to act on any general legal matter. A general Power of Attorney must still list the specific acts that the agent us allowed to perform, but it is overall more general than the limited Power of Attorney. A durable Power of Attorney will remain effective even if the principal becomes incapacitated. A limited and a general power of attorney will terminate if the principal becomes incapacitated.

A Power of Attorney must be carefully drafted in order to be effective. If the Power of Attorney is not drafted properly the entire document is useless.
